Terms of Service

These terms govern your use of elmvora.com and any purchase you make from us. By placing an order, you agree to them. Please read them before you buy.

They should be read alongside our Privacy Policy, Shipping Policy and Returns Policy.

Sunday and public holidays: closed. We respond within one working day.

Our store runs on Shopify Inc., which provides the e-commerce platform. Your purchase contract is with Elmvora LTD; Shopify is not a party to it.


2. Who can order

You must be at least 18 to place an order, or have the consent of a parent or guardian.

An account isn't required — guest checkout is available. If you create one, the login is yours to protect and activity under it is your responsibility.

You agree to provide accurate billing, delivery and contact details, and to keep them current so we can complete your order and reach you when needed.


3. Products and descriptions

We take reasonable care to ensure product descriptions, photographs, dimensions, materials and colours are accurate. Minor variation can occur through screen and device settings, photographic lighting, natural variation in materials and manufacturing tolerances.

Descriptions, availability and pricing may change at any time. We may discontinue a product or limit quantities per person, household or order.

Obvious pricing and typographical errors are not binding on us. Where an error affects your order, we'll contact you and you may continue at the corrected price or cancel the affected item for a full refund to your original payment method.


4. Prices

All prices are shown in pounds sterling and include VAT at the applicable rate. The total shown at checkout is the total you pay.

Standard UK delivery is free, and nothing further is added on delivery.

The price that applies is the one shown when you order, as confirmed in your order confirmation. Later changes don't affect orders already accepted.


5. How an order becomes a contract

Submitting an order is an offer to buy. You'll receive an acknowledgement email confirming we've received it.

The contract is formed when we confirm that your order has been dispatched.

We may decline or cancel an order before acceptance where a product is unavailable, payment can't be authorised, we identify a pricing or website error, we reasonably suspect fraudulent activity, delivery details are incomplete, or the order breaches these terms.

Where payment has been taken and we cancel, we refund in full.


6. Payment

Payment is taken when you place your order, using the methods shown at checkout.

Payments are processed securely by our providers, and we do not store your complete card details. By submitting payment information you confirm you're authorised to use that method.

Orders may be subject to reasonable verification and fraud-prevention checks. If a payment is declined or reversed, we may cancel the order.


7. Delivery

Processing and delivery timeframes are in our Shipping Policy, which forms part of these terms. Delivery is to UK addresses only.

Risk of loss passes to you on delivery — not when the parcel is handed to the carrier. If your order arrives damaged or doesn't arrive at all, contact us and we'll resolve it.

Delivery estimates are estimates. We're not liable for delays caused by carriers, weather or other events outside our reasonable control, though we'll help trace a delayed parcel.

Where we cannot dispatch your order within 30 days of purchase, we'll contact you and you may choose to wait for a revised date or cancel for a full refund.


8. Your right to cancel

As a consumer you have a statutory right to cancel within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, beginning the day after you receive the goods.

We voluntarily extend this to 30 days. You may cancel within 30 days of delivery, for any reason, without giving one.

This right applies after dispatch, and also to sale items.

How to cancel: email support@elmvora.com with your order number, or use the model cancellation form in section 10. We reply within one working day with the return address. Send the goods back within 14 days of telling us.

Refunds: we refund the full amount, including the standard delivery cost, within 14 days of receiving the goods back or of you providing evidence they were sent.

Return postage is yours where you've changed your mind; ours where the item is faulty, damaged or incorrectly supplied.

9. Faulty or misdescribed goods

Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described.

Where they aren't, you have a 30-day right to reject for a full refund. After 30 days you may ask for a repair or replacement; where that fails or isn't possible, you may claim a price reduction or a final right to reject.

These rights apply for up to six years from purchase. Any manufacturer's warranty is additional protection and never replaces them.

10. Model cancellation form

Complete this only if you wish to cancel. An email is equally acceptable.

11. Promotions

We may run promotions, discount codes, sales and competitions. Additional terms may apply to individual promotions and will be shown where relevant.

Unless stated otherwise, codes have no cash value, must be entered correctly at checkout, can't normally be applied after an order is completed, and may exclude certain products.

Nothing relating to a promotional price affects your statutory rights.


12. Reviews and submissions

You retain ownership of what you submit. By sending us a review, photograph, suggestion or other content, you grant us a non-exclusive, royalty-free licence to use, reproduce, edit and display it for legitimate business purposes, including displaying reviews and promoting our products.

You confirm that your content is your own or submitted with permission, is truthful and based on genuine experience, doesn't infringe anyone's intellectual property or privacy rights, contains no unlawful, defamatory or abusive material, and contains no malicious code or spam.

We may remove content that breaches these terms. We're not obliged to keep submissions confidential, to pay for them, or to respond.


13. Intellectual property

The website and its content — including the Elmvora name and branding, logos, site design, product photography, graphics, product descriptions and written content — are owned by or licensed to Elmvora LTD and protected by copyright, trade mark and other intellectual property law.

You may use the website for personal, non-commercial purposes. Without our written permission you must not copy or reproduce substantial content, republish it elsewhere, modify it, sell or commercially exploit it, use our branding misleadingly, or claim our content as your own.

If you believe material on our site infringes your copyright, contact support@elmvora.com with the details needed to assess the claim.


14. Acceptable use

You must not use our website for unlawful or fraudulent purposes, to submit false or misleading information, to impersonate another person or organisation, to introduce viruses or malware, to attempt unauthorised access to our systems, to interfere with security or normal operation, to send spam, to misuse another person's personal information, or to scrape or extract content in a way that infringes our rights.

We may restrict access where we reasonably believe these terms have been seriously breached.


15. Website availability

We take reasonable steps to keep the website available and working, but we can't guarantee uninterrupted access. It may occasionally be unavailable for maintenance, technical problems, security updates or circumstances outside our reasonable control.

We may update, change or temporarily suspend parts of the website where reasonably necessary.

Nothing in this section affects rights relating to an order already accepted.


16. Third-party links and services

Our website may link to or use third-party services relating to payments, delivery, functionality, social media and analytics. These operate independently and are subject to their own terms and privacy policies.

We're not responsible for the content of third-party websites we don't control.


17. Privacy and cookies

We process personal information in accordance with our Privacy Policy and UK data protection law.

We use cookies to operate the site, remember your preferences and understand how it's used. Non-essential cookies are set only with your consent, which you can withdraw at any time through our cookie controls or your browser settings.


18. Our responsibility to you

Nothing in these terms excludes or limits our liability where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights under the Consumer Rights Act 2015, and for anything else that cannot lawfully be excluded.

If we fail to comply with these terms, we're responsible for loss or damage that is a foreseeable result of our breach or of our failure to use reasonable care and skill. We're not responsible for loss that isn't foreseeable.

Our total liability arising from any order is limited to the amount you paid for that order.

Our products are supplied for personal and domestic use. Where it may lawfully be excluded, we're not responsible for business losses.


19. Indemnity

To the extent permitted by law, you agree to indemnify Elmvora LTD and its officers, employees, agents and service providers against reasonable claims, losses and legal expenses arising from your breach of these terms, your breach of any law, or your infringement of a third party's rights.


20. Events outside our control

Delays or disruption may occasionally arise from severe weather, transport disruption, industrial action, major technical failures, disruption to delivery networks, or government action.

Where such an event materially affects an accepted order, we'll take reasonable steps to minimise the impact and keep you informed.

Nothing in this section removes statutory rights relating to delayed or failed delivery.


21. Complaints and dispute resolution

If something goes wrong, contact us at support@elmvora.com. We respond within one working day and aim to resolve complaints within 14 days.

Where we can't resolve a complaint to your satisfaction, you may be able to refer it to an alternative dispute resolution provider. We are not currently a member of an ADR scheme. That doesn't affect your right to bring a claim through the courts, or to seek free advice from Citizens Advice (citizensadvice.org.uk, 0808 223 1133).


22. General

If any provision of these terms is found unenforceable, the remainder continue in full force. Our failure to enforce a provision isn't a waiver of it.

These terms, together with our Privacy Policy, Shipping Policy and Returns Policy, form the entire agreement between us.

We may update these terms where reasonably necessary. The current version is always on this page with the date at the top, and changes don't apply retroactively to orders already accepted.
